General terms and conditions of rental
Article 1 – Purpose
These general terms and conditions govern the seasonal rental of the three apartments (185 route du Chapeau Le Lavancher 74400 Chamonix), hereinafter referred to as ‘Enjoy Chalet’, made available by the Lessor to the Lessee.
Article 2 – Length of stay
The rental is concluded for a fixed period specified in the contract or reservation. The Lessee may not under any circumstances claim the right to remain in the premises at the end of the stay.
Article 3 – Reservation and payment
The reservation becomes firm upon receipt of a deposit of 30% of the total rental amount.
The balance must be paid no later than 30 days before arrival.
Failure to pay within this period will result in the reservation being automatically cancelled.
Article 4 – Security deposit
A security deposit of €500 is required on arrival.
It will be returned within a maximum of 8 days after the Tenant’s departure, less any sums due for repairs, replacement of equipment or additional cleaning.
Article 5 – Cancellation
- In the event of cancellation by the Tenant more than 31 days before arrival, a full refund will be given.
- In the event of cancellation between 14 and 30 days before the start of the stay, 30% of the rent remains due.
- In the event of cancellation 14 days before the start of the stay, the full rent remains due.
- In the event of cancellation by the Landlord, the Tenant will be refunded the full amount paid.
Article 6 – Use of the premises
The Tenant undertakes to:
- Enjoy the Accommodation peacefully and use it in accordance with its intended purpose.
- Not exceed the maximum number of persons authorised: – Loriaz Apartment: 4/5 persons – Bellachat Apartment: 6/8 persons – Cosmiques Apartment: 8 persons
- Comply with the internal rules displayed in the accommodation.
- Not to organise parties or events without the prior agreement of the Lessor.
- Not to smoke indoors (unless otherwise stated).
- Animals are not allowed.
Article 7 – Inventory and maintenance
An inventory may be carried out on arrival and departure.
The Tenant must keep the Accommodation in good condition and return it clean.
A cleaning fee of €500 may be applied.
In the event of damage, the Tenant is financially responsible for repairs.
Article 8 – Insurance and liability
The Tenant is liable for any damage caused by them.
They are advised to check that they have holiday insurance covering their liability in the event of an accident.
The Landlord declines all responsibility in the event of theft, loss or damage to the Tenant’s personal belongings.
Article 9 – Times
- Arrival: from 4 p.m.
- Departure: before 10 a.m. Any late departure may result in additional charges.
Article 10 – Applicable law and disputes
This contract is subject to French law.
In the event of a dispute, the parties shall endeavour to find an amicable solution.
Failing this, the competent court shall be that of the place where the Accommodation is located.
